5. Payment Terms
5.1 No Direct Payments on Site
This Site does not process payments or offer direct purchase functionality. All pricing, payment terms, and invoicing are handled through separate project agreements and contracts.
5.2 Project Agreements
Payment terms for custom development projects are determined on a case-by-case basis and will include:
- Total project cost and pricing structure
- Payment schedule (e.g., deposits, milestones, final payment)
- Accepted payment methods
- Late payment fees or interest (if applicable)
- Refund or cancellation policies specific to the project
6. Project Termination and Cancellation
6.1 Termination by Client
Clients may terminate a project in accordance with the terms outlined in the project agreement. Typically, clients are responsible for payment for all work completed up to the point of termination.
6.2 Termination by BitByte Forge
We reserve the right to terminate or suspend services if:
- Payment obligations are not met
- The client violates the terms of the project agreement
- The client engages in abusive, threatening, or illegal behavior
- Continuing the project becomes impractical or impossible
6.3 Effect of Termination
Upon termination, clients will receive deliverables for work completed and paid for. BitByte Forge retains the right to withhold deliverables until all outstanding payments are settled.
7. Confidentiality
Both parties agree to maintain confidentiality of proprietary and sensitive information shared during the course of any project engagement. This includes:
- Business strategies, plans, and financial information
- Technical data, source code, and designs
- Customer data and trade secrets
Confidentiality obligations will be detailed in individual project agreements or separate Non-Disclosure Agreements (NDAs) when applicable.
8. Warranties and Disclaimers
8.1 Service Quality
BitByte Forge strives to deliver high-quality services and will perform work in a professional manner consistent with industry standards. Specific warranties for project deliverables will be outlined in project agreements.
8.2 No Guarantees of Results
We do not guarantee specific business outcomes, revenue increases, or user engagement metrics as a result of our services. Results depend on many factors outside of our control.
8.3 Third-Party Services
Our services may rely on third-party platforms, APIs, and tools. We are not responsible for the availability, performance, or changes made by third-party service providers.
9. Indemnification
You agree to indemnify and hold harmless BitByte Forge, its officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
